Introduction
This document outlines the terms and conditions (hereinafter referred to as “Terms”) governing the participation of social media influencers (hereinafter referred to as “Affiliates”) in GiggleGrass’s Affiliate Marketing Program (hereinafter referred to as “Program”). By participating in the Program, the Affiliate agrees to be bound by these Terms.
Eligibility
To be eligible for participation in the Program, the Affiliate must:
2.1. Be at least 18 years of age.
2.2. Have an active social media presence with a minimum number of followers or subscribers, as determined by GiggleGrass .
2.3. Comply with all applicable laws and regulations in India, including but not limited to the Indian Contract Act, 1872, the Information Technology Act, 2000, and guidelines issued by the Advertising Standards Council of India (ASCI).
Enrollment Process
3.1. Affiliates must submit an application for enrollment through GiggleGrass’s website or any other method specified by GiggleGrass.
3.2. GiggleGrass reserves the right to accept or reject any application at its sole discretion.
Affiliate Responsibilities
4.1. Affiliates must promote GiggleGrass and its products in a professional, ethical, and lawful manner.4.2. Affiliates must disclose their relationship with GiggleGrass and indicate that they may earn a commission for purchases made through their referral links, in accordance with applicable laws and guidelines.
4.3. Affiliates must not engage in any misleading, deceptive, or fraudulent practices.
Commissions
5.1. Affiliates will earn a commission for each qualifying purchase made by a customer who accesses GiggleGrass’s website through their unique referral link.5.2. The commission rate and payment terms will be specified in a separate agreement or in the Affiliate’s account dashboard.
5.3. GiggleGrass reserves the right to modify commission rates and payment terms at any time with prior notice to Affiliates.
Payment
6.1. Commissions will be paid to Affiliates on a monthly basis or as otherwise specified in the Affiliate’s account dashboard.6.2. Payments will be made through a payment method approved by GiggleGrass.
6.3. GiggleGrass reserves the right to withhold or adjust payments in cases of suspected fraudulent activity or violation of these Terms.
Termination
7.1. Either party may terminate the Affiliate’s participation in the Program at any time, with or without cause, by providing written notice to the other party.7.2. Upon termination, the Affiliate must immediately cease all promotion of GiggleGrass and its products and remove all referral links from their social media channels.
Limitation of Liability
8.1. GiggleGrass shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the Program or these Terms.8.2. GiggleGrass maximum aggregate liability under these Terms shall not exceed the total amount of commissions paid or payable to the Affiliate.
